 Liability Waiver
Attendee is legally responsible for their safety and behavior and agrees to, and is held legally liable to, the following statements: I, the willing Attendee of the Seminar and/or participant in the Program and/or Products hereby accept all risk to my health and of my injury or death that may result from participating in the Seminar/ Program/ Products and I hereby release Promoter, Florence Madzivire, Abundant Life Academy and all its invited guests , and their officers, employees, interns, contractors, sponsors and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Seminar/ Program/ Products, whether caused by negligence of the Promoter, its governing board, officers, employees, or representatives, or otherwise.  I further agree to indemnify and hold harmless the Promoter, Florance Madzivire, Abundant Life Academy, invited speakers and guests, and any third- party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the Seminar/ Program/ Products. Under no circumstances will Promoter, Florance Madzivire, or their assigns be held liability for my injury or death or any loss or damage of my personal belongings resulting from my participation in the Seminar/Program/ Products. Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in the Seminar/ Program/ Products, I consent to such treatment. I acknowledge and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify Promoter verbally and in writing if I am at any time injured prior to, during, or after the Seminar/ Program in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that Promoter is not legally obligated to act on that information in any way or to providing any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully  participating in the Seminar/ Program/ Products that I will notify the Promoter and that the Promoter retains the right to ask that I not participate in portions of or the entirety of the Seminar/ Program/ Products.

Confidentiality and Non-Compete.

We respect your confidential and proprietary information, ideas, plans, copyrights, patents, trademarks, trade secrets and intellectual property rights (collectively, “Intellectual Property”) and must insist that you respect the same rights of fellow Seminar/ Program participants, Florance Madzivire and the Promoter. By your participation, you agree not to infringe on the Intellectual Property rights of any Seminar/ Program participant, Florance Madzivire, or the Promoter. Therefore you hereby understand and agree that the Intellectual Property as well as the tools, techniques, processes, formulas, strategies, concepts, materials, content, design, and information (hereafter referred to as “Intellectual Property and Confidential Information”) presented in the Seminar/ Program/ Products are confidential, copyrighted, and/or proprietary to the Promoter and/or Florance Madzivire and that any Intellectual Property and Confidential Information shared by Seminar/ Program/ Products participants or any representative of the Promoter is confidential and proprietary, and belongs solely and exclusively to the participant who discloses it or to the Promoter.  Therefore you, the Attendee, hereby agree not to record, duplicate, distribute, teach or train the Seminar/ Program/ Products Intellectual Property and Confidential Information in any manner whatsoever without the express written permission of the Promoter and/or Florance Madzivire and Abundant Life Academy. You agree to treat all Intellectual Property and Confidential Information as valuable, special and unique assets of the Promoter and/or Florance Madzivire and Abundant Life Academy and will protect the Intellectual Property and Confidential Information and treat it as strictly confidential.

 

Additionally, any unauthorized use or distribution of the Seminar/ Program/ Products Intellectual Property and Confidential Information by you or your representatives is prohibited and Promoter will pursue legal action and full damages if these terms are violated in order to protect its rights. You hereby understand and agree that violation of this paragraph will be a material violation of the Terms and Conditions of this Agreement and will justify legal and/or equitable relief. You hereby agree that if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph the Promoter will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.  While you are free to discuss your personal results from the Promoter’s Seminars, Programs, Products and training, you must keep the experiences and statements, oral or written, of Florance Madzivire, Abundant Life Academy and all participants in the strictest of confidence.

Audio/Visual Rules and Release
Attendees of Abundant Life Academy courses and seminars may not use any type of recording device to capture the information provided at the Seminar/ Program/ Products. No audio recording, photography or videography is allowed in the Seminar room or is to be used to capture information provided in Program/ Products.  By participating in the Seminar/ Program, Attendee understands that portions of the Seminar/ Program may be recorded in video and audio and/or captured in still and/or digital photographs by the Promoter. Attendee agrees the Promoter and its assigns have the right and permission to use such recordings and photographs should they include Attendee’s name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Attendee. Attendee understands and agrees that all recordings from the Promoter’s events are the exclusive rights of the Promoter and Attendee does not ask for or expect compensation for the use of recordings or photographs in which Attendee appears or speaks. In consideration of my approved attendance to Abundant Life Academy events and courses (“The Event”), I hereby acknowledge and agree:

 

  1. RIGHT TO PHOTOS & VIDEO:I hereby expressly (“ABUNDANT LIFE ACADEMY ”)and to its officers, employees, agents, and assignees the right to capture, record, and use photographs, video, and/or audio impressions (including live or over the Internet) of me (collectively, “Impressions”) recorded by ABUNDANT LIFE ACADEMY  at EVENT and to use the photographs and my voice and picture, silhouette, and other reproductions of physical likeness and class-related work (including any still image, videotaped image, captured video-conference image, CD-ROMs, DVDs and/or other analog or digital means, or other media now in existence of hereafter developed), in connection with or as part of any presentation, program, publication, product, transmission, or other professional endeavor in which the same may be used or incorporated, and also in the advertising, and/or publicizing of any such analog or digital works or their content, in perpetuity. I understand these images / sounds may be used for commercial, educational, or informational purposes. I shall not be entitled to any royalties, fees, or other compensation or notice, in connection with any such use. In addition, I waive any claims that any use of my photograph, image, and/or voice as permitted hereunder portrays me in a derogatory manner or false light.

 

  1. OWNERSHIP OF MATERIALS:I agree that ABUNDANT LIFE ACADEMY  shall exclusively own, jointly and severally, all rights, title and interest, including copyright in, and to, the complete set of Impressions, with worldwide rights. ABUNDANT LIFE ACADEMY  shall have the right, for any purpose, to use, adapt, change, delete from or add to such form and content, to combine all or any part of these original recordings with others, and to use, distribute, advertise, market and otherwise exploit any and all of the foregoing in any manner and in any medium, as ABUNDANT LIFE ACADEMY  shall determine in its sole discretion. I agree to cooperate with ABUNDANT LIFE ACADEMY , at its expense, in all further actions, which ABUNDANT LIFE ACADEMY  deems necessary or desirable to confirm, register, protect or enforce ABUNDANT LIFE ACADEMY 's rights in and to such recordings. I waive all rights of copyright or ownership which I might otherwise have in or to any of the products in which my image, likeness or voice appears, and I agree to assign, and do hereby assign, to ABUNDANT LIFE ACADEMY  any such right, title, and interest in and to any such products. I agree to execute all documents deemed necessary or desirable by ABUNDANT LIFE ACADEMY  in connection therewith. I waive all rights of copyright or ownership in or to the resulting commercial or educational and informational materials in which I appear, and acknowledge no monetary or other compensation is provided in exchange for waiving this right. I also agree to allow all forms of distribution of any materials that accompany the images or my voice. 

 

  1. NO GUARANTEES:The Event may include presentations about income growth opportunities. I understand that there can be no assurance that any prior successes by other individuals, or past results in income earnings, can be used as an indication of my future success or results. I acknowledge monetary and income results are based on many factors. ABUNDANT LIFE ACADEMY does not guarantee or imply that I will get rich, that I will do as well, or that I will make any money at all, especially if I do not do the work that’s asked of me or I ignore any other advice presented to me. ABUNDANT LIFE ACADEMY ’s products may have unknown risks involved, and are not suitable for everyone. Making decisions based on any information presented in ABUNDANT LIFE ACADEMY ’s products, services, or web site, should be done only with the knowledge that I could make no money at all. All products and services by ABUNDANT LIFE ACADEMY  are for educational and informational purposes only.

DUE DILIGENCE:I agree that I am solely responsible for doing my own due diligence when it comes to making business and financial decisions and all information, products, and services that have been provided by ABUNDANT LIFE ACADEMY  or at the Event should be independently verified by my own qualified professionals including checking with my accountant, lawyer or professional advisor, before acting on this or any information.

RESPONSIBILITY FOR OWN ACTIONS:ABUNDANT LIFE ACADEMY ’s information, products, and services should be carefully considered and evaluated, before reaching a business decision, on whether to take any action (or refrain from acting). I agree that ABUNDANT LIFE ACADEMY  is not responsible for the success or failure of my business decisions relating to any information presented at the Event or elsewhere by ABUNDANT LIFE ACADEMY  or others, or ABUNDANT LIFE ACADEMY ’s products or services.

 

  1. COPYRIGHT AND CONFIDENTIALITY NOTICE:The materials and resources used in this training are the confidential and exclusive copyrighted and proprietary intellectual property of ABUNDANT LIFE ACADEMY . These materials are provided to me by ABUNDANT LIFE ACADEMY  and solely intended for my personal use as an Event Participant. No part of these documents and/or resources can be stored, reproduced or transmitted in any form or by any means (electronic, photographic, mechanical, or any other medium), recorded, translated, or used to produce any derivative works without the explicit written permission of ABUNDANT LIFE ACADEMY , under signature. Any violation, or the likelihood of violating, any of my agreements contained in this paragraph, would entitle ABUNDANT LIFE ACADEMY  to injunctive relief to prohibit any such violations. Should Abundant Life Academy  commence any legal action in response to my act or omission in violation of this provision, I shall pay all of ABUNDANT LIFE ACADEMY ’s legal fees and court costs, in addition to all damages requested by ABUNDANT LIFE ACADEMY .

 

  1. VIDEOCONFERENCE:If I participate in the Event by videoconference, I will not display any background that includes any copyrighted image or logo that I do not own. If I own an image or logo that I display as part of a background, I hereby grant Abundant Life Academy  a royalty-free and irrevocable license to use said image and/or logo captured as part of the Impressions as otherwise permitted hereunder.

 

  1. LIABILITY WAIVER AND ACKNOWLEDGMENT OF RISK:I understand and agree that in participating in any movement class or workshop that there is a possibility of physical injury. ABUNDANT LIFE ACADEMY  recommends that I check with my physician before engaging in this class, and I have done so, or made a decision that I do not need to do so.

 

I voluntarily agree, therefore, to assume all risks and responsibility for any such injury or accident, which might occur to me during the movement class or workshop. I also exempt, release, and indemnify ABUNDANT LIFE ACADEMY , its officers, directors, owners, volunteers, assistants, employees, guest artists, faculty members, contractors, and agents, from any and all liability claims, demands, causes of action, damages, injuries, losses, or death, arising in any way (directly or indirectly) in connection with participation in any class or workshop offered by ABUNDANT LIFE ACADEMY . I understand that I should be aware of my physical limitations and agree not to exceed them.
